General Terms and Conditions SynMotoWorks
Article 1 – Definitions
In these general terms and conditions, the following definitions apply:

Entrepreneur: the natural or legal person who offers products or services to consumers, in this case SynMotoWorks.

Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement with the entrepreneur.

Agreement: any mutual arrangement between consumer and entrepreneur whereby products are delivered.

Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between entrepreneur and consumer.
Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer.
Deviations from these conditions are only binding if expressly agreed upon in writing.
Article 4 – The Offer
All offers are without obligation and can be revoked, unless a period for acceptance has been stated in the offer.
The entrepreneur reserves the right to refuse an order or request.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the entrepreneur's offer and meets the conditions attached to it.
The entrepreneur confirms receipt of the acceptance of the offer immediately by e-mail.
Article 6 – Right of Withdrawal
The consumer has the right to dissolve the agreement without giving reasons within 14 days after receipt of the product.
The withdrawal period starts the day after the consumer receives the product.
To exercise the right of withdrawal, the consumer must inform the entrepreneur within this period.
After withdrawal, the consumer shall return the product without delay and in any case within 14 days.
The costs of returning the product are for the consumer, unless otherwise agreed.
The entrepreneur will refund the purchase amount, including any shipping costs, within 14 days after receipt of the returned product.
Article 7 – Exclusion of the Right of Withdrawal
The right of withdrawal is excluded for:

Products that are manufactured according to the consumer’s specifications or clearly personal in nature.

Opened sealed goods that cannot be returned for health or hygiene reasons if the seal is broken.
Article 8 – Prices and Payment
All stated prices are including VAT, as SynMotoWorks is currently not registered for the Small Business Scheme (KOR) and is therefore required to charge VAT.
Shipping costs are not included in the prices unless otherwise specified.
Payment must be made within the period specified by the entrepreneur.
Article 9 – Delivery and Execution
The entrepreneur will deliver the ordered product as soon as possible, but no later than 30 days after receipt of payment.
If the delivery period is exceeded, the consumer has the right to dissolve the agreement.
Article 10 – Guarantee
The entrepreneur guarantees the quality of the delivered products and complies with the statutory warranty conditions.
If the product does not comply with the agreement, the consumer must report this within a reasonable time.
Article 11 – Liability
The entrepreneur's liability is limited to the amount paid out by the liability insurance in the relevant case.
Article 12 – Complaints Procedure
Complaints about the execution of the agreement can be reported to the entrepreneur via info@synmotoworks.nl.
Complaints will be handled within 14 days.
Article 13 – Applicable Law and Disputes
All legal relationships involving the entrepreneur are governed exclusively by Dutch law.
Disputes will preferably be resolved amicably. If this is not possible, disputes will be submitted to the competent court in the Netherlands.
Article 14 – Delivery and Execution (Detailed)
SynMotoWorks will exercise the utmost care when receiving and processing orders of self-produced products.
The place of delivery is the address provided by the consumer to SynMotoWorks.
SynMotoWorks will deliver accepted orders promptly, but no later than 30 days after payment has been received, unless a different delivery period has been agreed or the consumer has agreed to a longer term.
If delivery is delayed or if an order (partially) cannot be delivered, the consumer will be informed within 30 days after ordering. The consumer has the right to dissolve the agreement free of charge and may be entitled to compensation.
In case of dissolution as described above, SynMotoWorks will refund the amount paid within 14 days after dissolution.
If delivery is impossible, SynMotoWorks will strive to offer a suitable replacement product and inform the consumer accordingly. The right of withdrawal remains applicable for replacement products, and return costs will be borne by SynMotoWorks.
The risk of damage and/or loss of products lies with SynMotoWorks until the moment of delivery to the consumer or a designated representative, unless expressly agreed otherwise.
Returns are possible within 14 days after receipt of the goods, in accordance with the return policy on the SynMotoWorks website. If the consumer does not package the products correctly and damage or loss occurs during return shipment, the risk lies with the consumer.
Article 15 – Duration Transactions: Duration, Termination and Renewal
This article does not apply as SynMotoWorks mainly offers one-time sales of own products and does not provide subscriptions or regular deliveries.
Article 16 – Payment
Unless otherwise agreed, payments must be made within 7 working days after concluding the agreement (after ordering).
The consumer is obliged to immediately notify SynMotoWorks of any inaccuracies in payment details.
In case of non-payment, SynMotoWorks reserves the right to charge reasonable collection costs to the consumer.
Article 17 – Complaints Procedure (Detailed)
Complaints regarding the execution of the agreement must be reported to SynMotoWorks within 7 days after discovery, in writing or by e-mail, with a clear description of the problem.
SynMotoWorks will respond substantively within 14 days after receiving the complaint. If more time is required, an acknowledgement of receipt and indication of further handling will be sent within 14 days.
If complaints cannot be resolved amicably, the dispute can be submitted to a complaints committee.
Filing a complaint does not suspend SynMotoWorks’ obligations unless agreed otherwise in writing.
If a complaint is justified, SynMotoWorks will repair or replace the product free of charge at its discretion.
Article 18 – Disputes
Dutch law exclusively applies to all agreements between SynMotoWorks and the consumer, even if the consumer lives abroad.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Article 19 – Liability
SynMotoWorks delivers self-manufactured products, which the consumer installs themselves. The consumer is responsible for correct installation and use of the products.
SynMotoWorks is not liable for damage resulting from incorrect installation, misuse, or modifications after delivery.
Examples of situations for which SynMotoWorks does not accept liability:

Theft of the product after delivery

Damage caused by improper use or installation

Damage caused by external factors such as fire, water, or traffic accidents

Installation errors by the consumer or third parties

Warranty on the vehicle on which the product is mounted
All other legal liabilities are limited to the amount SynMotoWorks receives for the relevant order.
